There’s a particular kind of riding that Ontario demands: constant vigilance in freight traffic. Between the semis running the I-10 and I-15, delivery fleets working the warehouse districts, and commuters packing the 60, local riders navigate blind spots the size of houses every single day. Most do it flawlessly. The crash, when it comes, usually starts in someone else’s mirror — a lane change the driver never checked, a left turn across your right of way, a following distance that never existed.

Then comes the second fight: the insurance company’s version of events, where the rider is presumed reckless until proven otherwise. Miracle Law exists to win that fight. Founder Tamar Miot defended insurers for years before switching sides — she knows how adjusters frame rider claims, and how to dismantle the framing.

The Numbers Behind Rider Risk

The disparity is stark. According to NHTSA, motorcyclists are killed in crashes at a rate roughly 24 times that of passenger-car occupants per vehicle mile traveled, and motorcyclists represent a share of traffic deaths many times their share of traffic. In a freight-heavy city like Ontario, the most dangerous scenarios multiply: trucks with massive blind spots, wide right turns that close escape routes, and stop-and-go congestion where drivers change lanes on impulse.

None of that is the rider’s fault — but insurers often act as if it were.

Taking Back the Narrative

Insurance adjusters start building their version of your crash immediately. Our job is to get there first, or failing that, to out-evidence them:

  1. Scene and vehicle evidence — skid marks, debris fields, impact points, and damage patterns that show how the collision actually unfolded
  2. Footage — traffic cameras, business surveillance, dashcams, and helmet cams, gathered before deletion cycles erase them
  3. Witnesses — located and interviewed while memories are fresh
  4. Medical documentation — the complete arc of your injuries, from ER through rehabilitation, including future care your doctors project

California law backs you up. Lane splitting is legal — being between lanes when a driver hit you is not automatic fault. Pure comparative negligence means even shared fault only reduces, never erases, your recovery. And you generally have two years to file under CCP § 335.1 — though a six-month government claim deadline applies if a public entity’s dangerous road condition played a role.

Protect Your Claim in the First Week

A few moves in the days after your crash pay off for months. Seek full medical evaluation immediately and follow every referral — insurers read gaps in treatment as proof you weren’t hurt. Keep your damaged helmet, gear, and bike untouched; they are evidence of impact forces, and repairing or discarding them destroys it. Write down everything you remember about the crash while it’s fresh, including what the driver said at the scene — apologies and admissions have a way of vanishing from later accounts.

And be careful with two things: social media, where a single photo of you smiling at a barbecue becomes Exhibit A that you’re fine, and the other insurer’s “quick questions,” which are neither quick nor innocent. Let your attorney do the talking. From the day Miracle Law takes your case, every adjuster call comes to us.

Serious Cases, Serious Results

Rider injuries — traumatic brain injury, spinal damage, complex fractures — demand full valuation, not quick settlements. Miracle Law’s results include a $3.85 million truck accident recovery and a $5 million wrongful death recovery; past results don’t guarantee future outcomes, but they show how we prepare. We handle every crash type in the city through our Ontario personal injury practice, including car accidents and truck accidents, and we represent riders across the region — read about our firmwide motorcycle accident practice.

Frequently Asked Questions

How does riding around commercial trucks affect my claim?

Truck-versus-motorcycle crashes are among the most severe cases we handle, and they add commercial defendants and insurance layers to your claim. If a big rig or delivery vehicle was involved, your case may be worth substantially more — and will be fought harder.

The police report blames me. Is my case over?

No. Police reports are important but not final — officers don't always witness the crash, and rider bias can color initial conclusions. We regularly overcome unfavorable reports with reconstruction, camera footage, and witness evidence.

Does not wearing full gear reduce my compensation?

California requires helmets, and failure to wear one can reduce recovery for head injuries under comparative negligence. But it doesn't eliminate your claim, and it's irrelevant to injuries a helmet wouldn't have prevented. Each case turns on its facts.

What will a lawyer actually do for my motorcycle claim?

Preserve evidence before it's gone, handle every insurer contact, document the full extent of your injuries and future needs, counter rider bias with facts, and negotiate — or litigate — for full value. All on contingency: no fee unless we win.
