Los Angeles Pedestrian Accident Lawyer — Miracle Law practice area

A car can weigh 4,000 pounds. You weigh a fraction of that, and when a driver isn’t paying attention, you have no steel frame, no airbags, and no second chances. If you or someone you love was struck by a vehicle in Los Angeles, our pedestrian accident lawyers know how to hold the driver — and their insurance company — fully accountable.

Miracle Law is headquartered in downtown Los Angeles at 633 W. 5th Street, blocks from some of the busiest pedestrian corridors in California. Founder Tamar Miot spent years as an insurance defense attorney, so she knows exactly how insurers try to shift blame onto the person who was walking.

Pedestrian Deaths Are Near Historic Highs

This isn’t your imagination — walking has become more dangerous. According to the Governors Highway Safety Association (GHSA), drivers struck and killed 7,318 pedestrians in the U.S. in 2023, and the 2022 toll was the highest in more than four decades. Deaths dipped slightly in 2024 but remain nearly 20% above 2016 levels. Larger vehicles, bigger blind spots, distracted driving, and speeding all play a role — we break down the causes in our article on why pedestrian accidents are at a 30-year high across the U.S.

California bears an outsized share of that toll. The California Office of Traffic Safety reported 1,106 pedestrian deaths statewide in 2023, and pedestrians account for roughly a quarter of all California traffic fatalities. Los Angeles — with its wide arterials, long blocks, and heavy traffic — is consistently among the most dangerous places in the country to be on foot.

Your Rights — In or Out of the Crosswalk

Insurance adjusters love one word in pedestrian cases: jaywalking. Don’t let it scare you.

  • In a marked or unmarked crosswalk, drivers must yield to you. Most intersections in Los Angeles have unmarked crosswalks by law, even with no painted lines.
  • Outside a crosswalk, you still have a claim. Drivers owe everyone on the road a duty of reasonable care under Civil Code § 1714 — including a duty to watch for pedestrians, control their speed, and avoid people in the roadway. If you were hit mid-block, read our guide: I was struck by a car but I was not in a crosswalk — what now?
  • Even if you share fault, California’s pure comparative negligence rule means your recovery is reduced by your percentage of fault — never eliminated. A pedestrian found 30% at fault still recovers 70% of their damages.

Adjusters routinely inflate a pedestrian’s share of blame to slash payouts. We push back with physical evidence, camera footage, and reconstruction — not their version of events.

Hit-and-Run and Uninsured Drivers

A disturbing number of LA pedestrian collisions are hit-and-runs. If the driver is caught, their liability insurance answers for your injuries. If they’re never found — or they’re uninsured — you may still have a path to compensation through uninsured motorist (UM) coverage on your own auto policy or a resident family member’s policy. Many injured pedestrians never realize this coverage applies to them on foot. We identify every available policy before any settlement conversation begins.

Injuries We See in Pedestrian Cases

Pedestrian victims take the impact directly, which is why these cases so often involve traumatic brain injuries, spinal damage, complex fractures, and internal injuries — and, tragically, why some become wrongful death claims. Building the full value of these damages means documenting future surgeries, rehabilitation, lost earning capacity, and the ways the injury has permanently changed your life. That’s the work we do on every case, and it’s reflected in our results, including a $5 million wrongful death recovery and a $1.1 million car accident recovery. Past results don’t guarantee future outcomes.

What to Do After a Pedestrian Accident

  1. Get medical care immediately — adrenaline masks serious injuries, and gaps in treatment become insurer talking points.
  2. Report the collision to police and get the report number.
  3. Preserve evidence — photos of the scene, your injuries, the vehicle, and names of witnesses. Nearby businesses may have camera footage that gets overwritten in days.
  4. Don’t give the insurer a recorded statement. Call a lawyer first.

Frequently Asked Questions

Can I still recover if I was hit outside a crosswalk?

Yes. Jaywalking doesn't bar your claim in California. Drivers always owe a duty of reasonable care to people on foot, and under pure comparative negligence you can recover even if you share fault — your award is simply reduced by your percentage of responsibility.

What if the driver who hit me fled the scene?

Hit-and-run claims are common in Los Angeles pedestrian cases. If the driver is never identified, the uninsured motorist (UM) coverage on your own auto policy — or a household family member's policy — can often pay your damages, even though you were on foot when you were hit.

How long do I have to file a pedestrian accident claim in Los Angeles?

Generally two years from the date of injury under California Code of Civil Procedure § 335.1. If a public entity is involved — a city vehicle, a dangerous intersection or signal — you may need to file a government claim within six months under Government Code § 911.2.

How much is my pedestrian accident case worth?

Pedestrians absorb the full force of a vehicle, so damages are often substantial: surgeries, rehabilitation, lost income, and lasting pain. Value depends on your injuries and the available coverage. Our results include a $1.1 million car accident recovery and a $5 million wrongful death recovery — past results don't guarantee future outcomes, but we build every case for full value.
